NIW for Scientists

Scientists frequently consider the EB2 National Interest Waiver because it permits qualifying applicants to self-petition without a traditional permanent job offer or PERM labor certification.

Scientific credentials alone do not establish NIW eligibility. The petition must first establish underlying EB2 eligibility and then satisfy the three-part Matter of Dhanasar framework.

Underlying EB2 Eligibility

A scientist must first qualify for EB2 as an advanced-degree professional or an individual of exceptional ability.

Many scientists qualify through a master’s degree, PhD or equivalent advanced education, but the EB2 threshold should be analyzed separately from the national interest waiver.

The Three NIW Requirements

The scientist must establish that:

  1. the proposed endeavor has substantial merit and national importance;
  2. the scientist is well positioned to advance the endeavor; and
  3. on balance, waiving the normal job-offer and labor-certification requirements would benefit the United States.

Scientific Research and Substantial Merit

Many scientific endeavors can demonstrate substantial merit because they advance knowledge, technology, health, environmental objectives or other important interests.

Substantial merit alone does not establish national importance.

Define the Specific Scientific Endeavor

A scientist should identify the actual work proposed rather than rely on a broad occupational description.

For example, “conducting medical research” is less specific than describing the disease, scientific mechanism, experimental approach and anticipated application of the research.

National Importance

National importance focuses on the proposed endeavor’s potential prospective impact.

Scientific research may be particularly relevant where it has potential broader implications in areas such as:

STEM Research

USCIS recognizes the importance of progress in science, technology, engineering and mathematics, particularly where proposed work relates to critical and emerging technologies, national security or other areas important to U.S. competitiveness.

However, merely holding a STEM degree does not automatically establish that the proposed endeavor has national importance.

Well Positioned

Scientific evidence supporting the second Dhanasar prong may include:

Publications and Citations

NIW does not require a minimum number of publications or citations.

The importance of these metrics depends on the scientist’s field, career stage and overall record.

They can help establish a track record of producing research that other scientists notice or use.

Early-Career Scientists

A scientist does not need to be a senior professor to seek NIW classification.

Postdocs and early-career researchers may potentially qualify when they can establish the required EB2 eligibility, national importance, well-positioned showing and third-prong balance.

Industry Scientists

Industry researchers may have strong NIW evidence that does not appear in traditional academic databases.

Useful evidence may include:

Medical Scientists

Scientists working in biomedical research may establish broader impact through work affecting disease mechanisms, diagnostics, clinical treatment, public health or medical technology.

The petition should connect the applicant’s actual proposed research to those broader implications.

Artificial Intelligence and Emerging Technology

AI and other emerging technologies can be important to U.S. competitiveness, but an NIW petition should still identify what the scientist personally proposes to research or develop and the prospective impact of that endeavor.

Recommendation Letters

Independent experts may help explain why specialized scientific work has broader implications and why the scientist’s prior record demonstrates the ability to advance it.

Letters should not substitute for objective evidence where such evidence is available.

Government Interest

Evidence that a U.S. government agency, federally funded program or other governmental entity has expressed interest in the applicant’s work can be particularly relevant in an appropriate case.

The significance depends on the nature of the interest and its connection to the proposed endeavor.

The Third Prong

The petition should explain why granting the waiver would benefit the United States despite the normal employment-based job-offer and labor-certification structure.

The analysis should be individualized to the researcher’s work.

NIW Versus EB1A for Scientists

EB1A requires extraordinary ability and sustained acclaim. NIW uses the Dhanasar framework and an underlying EB2 classification.
