NIW for PhD Students: Can You File Before Graduation?
A doctoral student may potentially qualify for a National Interest Waiver before completing the PhD. The unfinished doctorate does not itself establish EB2 eligibility, however. The applicant must already qualify for the underlying EB2 classification and must independently satisfy all three Matter of Dhanasar prongs.

A qualifying bachelor’s degree followed by the required progressive post degree experience may provide another advanced degree pathway.

Awards and Fellowships Competitive recognition relevant to the research.
Patents or Software Technical outputs that may demonstrate progress.
Future Research Plan Work that extends beyond completion of the degree.
Common Mistake
The Proposed Endeavor Should Not Be “Finish My PhD”
Too Narrow
“My proposed endeavor is to complete my doctorate.”
Degree completion describes an educational milestone, not necessarily the professional endeavor the applicant intends to advance in the United States.
Stronger
Describe the research that continues after graduation.
Identify the scientific problem, research direction, anticipated applications and broader prospective impact of the applicant’s continuing work.

Must I finish my PhD before filing NIW?
Not necessarily. You must, however, independently establish underlying EB2 eligibility and all NIW requirements when the petition is filed.
Does PhD enrollment itself qualify me for EB2?
No. Enrollment alone is not a completed advanced degree.
Can a PhD student qualify with few citations?
Potentially. NIW has no fixed citation threshold. The complete evidence should be evaluated.
Should I file immediately or wait?
That depends on the legal eligibility and strength of the record at the proposed filing date.
