National importance is one of the most frequently disputed issues in EB2 National Interest Waiver cases.

Under Matter of Dhanasar, the first NIW prong requires the applicant to establish that the proposed endeavor has both substantial merit and national importance.

The central question is the prospective impact of the applicant’s specific proposed endeavor, not merely whether the applicant works in an important occupation, industry or academic field.

Substantial Merit and National Importance Are Different

An endeavor may clearly have substantial merit but still fail to establish national importance.

For example, scientific research, health care, education and engineering can have substantial merit. The petition must separately explain why the particular proposed endeavor has broader prospective implications.

What Does USCIS Evaluate?

USCIS considers the potential prospective impact of the endeavor.

The analysis focuses on what the applicant proposes to do rather than simply the occupation in which the applicant works.

The Field Is Not the Endeavor

It may be true that artificial intelligence, cancer research, renewable energy, cybersecurity or semiconductor technology is important to the United States.

That does not automatically establish that every person working in those fields has a nationally important endeavor.

The petition should explain the connection between the applicant’s specific work and the broader implications claimed.

Depending on the facts, a research endeavor may have broader implications for:

National Importance Does Not Require Nationwide Geography

An endeavor does not necessarily need to be performed throughout the entire United States to have national importance.

The important question is the endeavor’s potential broader impact.

Research performed at one laboratory, university or company may have implications that extend far beyond the physical location where the work occurs.

Scientific Research

Scientific work can have national importance where the evidence shows significant potential to advance a field, address an important problem or produce broader scientific or practical effects.

The petition should explain how the specific research contributes to those goals.

Medical Research

A medical research endeavor may have broader impact when it addresses disease prevention, treatment, diagnostics, medical technology or other significant public health needs.

Engineering Research

Engineering research may have national importance when it has broader implications for infrastructure, manufacturing, energy, transportation, aerospace, communications or other significant areas.

Artificial Intelligence and Critical Technology

Research involving critical or emerging technology can be highly relevant to national importance when the specific endeavor affects U.S. technological leadership, competitiveness, security or another significant national interest.

Merely labeling the work “AI” is not enough.

Economic Impact

Potential economic effects may support national importance, but Dhanasar does not require every NIW applicant to demonstrate job creation or direct economic impact.

Research, science, technology, health and education may possess national importance for reasons other than direct job creation.

Government Priorities

Government reports, statutes, agency programs and policy materials may help establish that the subject addressed by the endeavor is important to the United States.

However, the petition should also demonstrate how the applicant’s specific endeavor relates to that governmental priority.

Government Funding or Interest

Government funding, collaboration or other documented government interest may provide important evidence where it relates directly to the applicant’s proposed endeavor.

The evidence should identify the connection between the government interest and the applicant’s work.

Independent Evidence

A personal statement asserting that the endeavor is nationally important may be insufficient by itself.

Past Impact Versus Future Impact

Past achievements may provide evidence that the applicant has worked on important problems.

National importance, however, focuses on the prospective impact of the proposed endeavor.

The petition should explain what future work is expected to accomplish.

Publications and Citations

Publications and citations can demonstrate prior research influence and may help establish that the applicant is well positioned.

They do not automatically prove that the proposed future endeavor has national importance.

Recommendation Letters

Experts may explain the broader implications of specialized research.

A useful letter should discuss the applicant’s specific proposed endeavor rather than merely state that the applicant’s general field is important.

National Importance Versus Well Positioned

These are separate issues.

A proposed endeavor may be nationally important even if a particular applicant is not well positioned to advance it.

Conversely, an accomplished researcher may be well positioned professionally but fail to establish that the particular proposed endeavor has national importance.

National Importance Versus Employer Importance

Working for a famous university, major technology company or leading hospital does not automatically establish national importance.

The analysis focuses on the proposed endeavor.

National Importance Versus Local Benefit

An endeavor that primarily benefits one employer or a limited group may require additional explanation to establish broader implications.

The petition should demonstrate why the expected impact extends beyond routine benefits to the immediate employer or client.
