EB1B Original Research Contributions
Original scientific or scholarly research contributions to the academic field are one of the six EB1B evidentiary criteria for outstanding professors and researchers.
This criterion is especially important for researchers whose strongest evidence involves scientific discoveries, methods, technologies, datasets, algorithms, clinical research or other scholarly advances.

What Does the EB1B Regulation Require?
The EB1B regulation refers to evidence of the beneficiary’s original scientific or scholarly research contributions to the academic field.
Unlike the corresponding EB1A criterion, the EB1B regulatory language does not expressly require the contribution itself to be described as one “of major significance.”
However, satisfying the initial criterion does not end the case. USCIS still evaluates whether the total evidence demonstrates that the beneficiary is internationally recognized as outstanding.
Originality
The petitioner should first identify what the beneficiary actually created, discovered or developed.
Examples may include:
- a new scientific finding;
- a new research method;
- a novel algorithm;
- a new experimental technique;
- a significant dataset;
- new software used in research;
- an invention or patent;
- a clinical research advance; or
- a new scholarly theory or model.
The Beneficiary’s Personal Contribution
Modern research is frequently collaborative.
The petition should identify the beneficiary’s personal contribution instead of attributing the entire laboratory’s or company’s achievements to one researcher.
How Can Original Contributions Be Documented?
Potential evidence may include:
- peer-reviewed publications;
- patents;
- technical reports;
- research documentation;
- software or datasets;
- citations;
- independent adoption;
- licensing or commercialization;
- clinical implementation;
- government or industry use;
- expert letters; and
- other objective evidence showing the nature and influence of the contribution.
Citations
Citations can help show that other researchers noticed and used the beneficiary’s work.
The most useful citation evidence may identify not merely how many citations exist, but how independent researchers relied on or extended the contribution.

Independent Adoption
Evidence that unrelated researchers adopted the beneficiary’s methodology, software, dataset or scientific findings can provide strong evidence concerning the professional importance of the work.
Patents
A patent can establish that an invention was sufficiently novel to receive patent protection, but the existence of a patent does not by itself demonstrate broad professional recognition.
Additional evidence such as licensing, commercialization, implementation or independent use may help show the practical influence of the invention.
Industry Research
Private-sector researchers may produce important work that is not heavily published because of proprietary restrictions.
Relevant evidence may include:
- commercial implementation;
- product incorporation;
- patents and licensing;
- technical performance improvements;
- industry adoption;
- regulatory use;
- customer implementation; and
- independent recognition of the research.
Clinical Research
Medical or biomedical researchers may demonstrate contributions through clinical adoption, treatment protocols, diagnostic methods, cited clinical research or other evidence showing how the work influenced medical practice or later research.
Software and Algorithms
Researchers in computer science, artificial intelligence and engineering may produce software, open-source tools or algorithms that become widely used.
Download records, independent implementation, citations, incorporation into other systems and technical documentation may help demonstrate influence.
Datasets
A significant dataset can constitute an original research contribution when the evidence establishes the beneficiary’s role in creating it and demonstrates its use or importance in the academic field.
Recommendation Letters
Expert letters can explain technical work that would otherwise be difficult for a nonspecialist to evaluate.
The most useful letters identify specific contributions and explain how the author knows about them.

Independent Experts
Independent experts may provide useful evidence showing that the contribution became known beyond the beneficiary’s employer or immediate collaborator network.
The testimony is stronger when supported by citations, adoption records, patents, publications or other objective documentation.
Research Grants
Obtaining research funding can provide useful context, particularly where funding was awarded competitively based on the beneficiary’s research ideas or record.
A grant is not automatically an original contribution. The petition should explain what the grant evidence demonstrates.
Publication in a Prestigious Journal
Publishing in a highly ranked journal may demonstrate that the work passed a selective publication process, but journal reputation alone does not establish the beneficiary’s international recognition.
The influence of the particular research should be evaluated separately.
Original Contribution Versus Authorship
These are separate criteria.
An article can satisfy scholarly authorship without establishing an original research contribution. Conversely, a researcher may have important proprietary contributions that were never published in a traditional journal.

Criterion Stage Versus Overall Recognition
The original-contributions criterion is one part of the initial evidentiary analysis.
After at least two criteria are established, USCIS evaluates the total evidence to determine whether the beneficiary is internationally recognized as outstanding.
Evidence showing that a contribution had substantial influence may therefore be particularly important to the overall case even though the criterion’s regulatory wording does not contain the EB1A phrase “major significance.”
Common Contribution Evidence Problems
- describing research as novel without identifying the beneficiary’s personal contribution;
- relying only on recommendation letters;
- assuming publication automatically proves contribution impact;
- assuming a patent automatically demonstrates international recognition;
- claiming the achievements of an entire laboratory as the beneficiary’s own;
- failing to show independent use or recognition where such evidence exists; and
- confusing satisfaction of one criterion with the broader international-recognition standard.

A strong contribution argument identifies what the researcher personally created and uses objective evidence to show how that work became relevant to other researchers or the academic field.
