NIW for Engineering Researchers
Engineering researchers may qualify for an EB2 National Interest Waiver when their proposed endeavor has substantial merit and national importance and they satisfy the remaining Matter of Dhanasar requirements.
An engineering degree or employment in an important industry does not automatically establish NIW eligibility. USCIS evaluates the specific proposed endeavor and the applicant’s evidence.

Underlying EB2 Eligibility
The applicant must first qualify for EB2 as an advanced-degree professional or individual of exceptional ability.
Many engineering researchers qualify through master’s or doctoral education, although the national interest waiver requires a separate showing.
The Three Dhanasar Prongs
The applicant must establish:
- substantial merit and national importance of the proposed endeavor;
- that the applicant is well positioned to advance the endeavor; and
- that, on balance, waiving the job offer and labor certification would benefit the United States.
Define the Engineering Endeavor
The proposed endeavor should describe the actual engineering research or development the applicant plans to advance.
Rather than stating only “I intend to work as an engineer,” the petition may identify:
- the engineering problem;
- the technology or system being developed;
- the applicant’s technical methodology;
- anticipated performance improvements;
- potential applications;
- industry or governmental relevance; and
- the broader prospective impact.
National Importance
Engineering work may have broader implications in areas such as:
- energy infrastructure;
- semiconductors;
- advanced manufacturing;
- transportation;
- aerospace;
- robotics;
- communications;
- cybersecurity;
- water systems;
- environmental engineering;
- critical infrastructure; or
- other technologies important to U.S. competitiveness or security.
The petition should explain how the applicant’s particular endeavor affects those interests.
Critical and Emerging Technologies
Work involving a critical or emerging technology may be relevant to the NIW analysis, particularly where the proposed endeavor has implications for U.S. competitiveness or national security.
The applicant should still define the actual work and establish a credible connection between the endeavor and those broader implications.
Well Positioned
Evidence may include:
- advanced engineering education;
- specialized technical knowledge;
- research experience;
- peer-reviewed publications;
- citations;
- patents;
- prototypes;
- technical deployments;
- research grants;
- awards;
- industry collaborations;
- government projects;
- technical standards work; and
- prior successful engineering projects.
Publications and Citations
Engineering NIW petitions do not require a fixed number of publications or citations.
Academic researchers may use publication and citation evidence to demonstrate prior success and professional impact.
Patents
Patents may be particularly relevant for engineering applicants.
A patent alone demonstrates intellectual property protection but not necessarily broad impact. Licensing, commercialization, implementation or other use can provide additional evidence.
Prototypes and Technical Systems
Evidence that the applicant developed a functioning prototype, process or engineering system may help demonstrate progress toward the proposed endeavor.
Technical documentation should identify the applicant’s individual role.
Commercial Implementation
Engineering research implemented by companies, manufacturers or infrastructure operators may demonstrate practical impact beyond scholarly publication.
Useful evidence may include contracts, implementation records, technical reports or independent documentation of adoption.
Technical Standards
Work influencing professional or technical standards can provide evidence of broader industry impact.
The applicant should document the connection between the applicant’s own work and the standard.
Government-Funded Engineering Research
Research funded or supported by U.S. government agencies may provide useful evidence concerning the importance and feasibility of the proposed endeavor.
The significance depends on the applicant’s role and the relationship between the funding and the proposed work.
Industry Researchers
Engineers working in private industry may possess strong evidence that differs from traditional academic records.
Potential evidence includes:
- patents;
- product integration;
- technical deployment;
- manufacturing improvements;
- cost reductions;
- safety improvements;
- energy efficiency;
- commercial adoption; and
- independent recognition.
Recommendation Letters
Technical experts can explain why an engineering contribution matters and how the applicant’s work compares with existing technology.
Objective documentation should corroborate significant claims where possible.
NIW Versus EB1A for Engineers
EB1A requires extraordinary ability and sustained acclaim. NIW does not require extraordinary ability but requires underlying EB2 eligibility and the Dhanasar showing.
NIW Versus EB1B
Engineering researchers in qualifying permanent research positions may also consider EB1B when they satisfy its international-recognition and employer requirements.
Common Engineering NIW Problems
- relying only on the importance of engineering generally;
- describing an occupation instead of a proposed endeavor;
- calling a technology critical without showing how the applicant’s work relates to it;
- listing patents without evidence of their relevance or use;
- claiming company accomplishments as the applicant’s own;
- failing to explain prospective impact; and
- failing to address the third Dhanasar prong.
