Do Not Use Unrelated Company Revenue

A low citation count does not necessarily mean that research had little impact.

Verify Quantitative Claims

An unsupported recommendation letter claiming that technology saved millions of dollars is weaker than contemporaneous business records or other objective evidence documenting the result.
Applicant’s Personal Role
Real-world impact attributed to a company, university or research team does not automatically establish the applicant’s personal contribution.
The filing should explain:
- what the applicant created;
- what role the applicant played;
- how the contribution affected the result; and
- what independent evidence corroborates that role.
Impact Must Be Connected to the Legal Standard
Evidence should be used differently depending on the petition.
For example:
- EB1A may use implementation to demonstrate major significance;
- EB1B may use adoption to demonstrate research contributions and international recognition;
- NIW may use prior impact to demonstrate that the applicant is well positioned.
Common Research Impact Problems
- treating citations as the only evidence of impact;
- using company-wide results without connecting them to the applicant;
- claiming commercialization without documentation;
- using download numbers without proving meaningful use;
- claiming government adoption without official evidence;
- using recommendation letters as the sole proof of quantitative results;
- failing to distinguish team impact from personal contribution; and
- failing to connect impact evidence to the applicable immigration requirement.
