NIW for Medical Researchers
Medical and biomedical researchers may qualify for an EB2 National Interest Waiver when they satisfy the underlying EB2 requirements and establish that their specific proposed research endeavor meets the three-part Matter of Dhanasar framework.
The importance of medicine or public health generally does not automatically establish NIW eligibility. The petition should identify the particular research the applicant intends to advance and explain its prospective broader impact.

Medical Research NIW Versus Physician NIW
A research-based NIW under Matter of Dhanasar should not be confused with the separate statutory national interest waiver provisions available to certain physicians who agree to provide qualifying clinical service in designated underserved areas or Department of Veterans Affairs facilities.
A physician-scientist seeking NIW classification based primarily on research may instead present a Dhanasar-based research endeavor if the applicable requirements are satisfied.
Step One: Underlying EB2 Eligibility
The applicant must first qualify for EB2 as either:
- a member of the professions holding an advanced degree or equivalent; or
- an individual of exceptional ability in the sciences, arts or business.
Medical researchers often possess an MD, PhD, master’s degree or other advanced scientific education, but the degree alone does not establish the national interest waiver.
The Three Dhanasar Prongs
The applicant must establish that:
- the proposed medical research endeavor has substantial merit and national importance;
- the applicant is well positioned to advance the proposed endeavor; and
- on balance, it would benefit the United States to waive the normal job-offer and labor-certification requirements.
Define the Medical Research Endeavor
A proposed endeavor should identify the actual research rather than merely state that the applicant works in medicine.
A useful description may identify:
- the disease or medical problem;
- the biological mechanism or clinical question;
- the proposed experimental or analytical approach;
- the population or patient group affected;
- the technology, diagnostic or treatment involved;
- the expected research output; and
- the potential broader effect on health care or medical science.
Substantial Merit
Medical research addressing disease, diagnostics, treatment, prevention, health technology or biomedical science can often demonstrate substantial merit.
Substantial merit, however, is only part of the first Dhanasar prong. The applicant must also establish national importance.
National Importance in Medical Research
National importance focuses on the prospective impact of the specific research endeavor.
Potentially relevant considerations may include the endeavor’s implications for:
- public health;
- disease prevention;
- cancer research;
- infectious disease;
- cardiovascular disease;
- neurological disease;
- rare diseases;
- medical diagnostics;
- drug development;
- medical devices;
- health care efficiency; or
- other significant health needs.
The petition should connect these concerns to the applicant’s actual proposed research rather than rely on the general importance of medicine.
Basic Science Research
Medical research does not need to involve immediate clinical treatment to have national importance.
Basic scientific research may have broader implications when the evidence explains how understanding a biological mechanism, pathway or disease process could advance future diagnosis, prevention or treatment.
Clinical Research
Clinical researchers may demonstrate prospective impact through work involving:
- clinical trials;
- treatment outcomes;
- diagnostic validation;
- biomarkers;
- patient safety;
- comparative effectiveness;
- precision medicine; or
- other research that can affect medical practice.
Translational Research
Research translating laboratory findings into clinical or commercial applications may be particularly useful where the record demonstrates a credible pathway from scientific discovery to practical medical impact.
Well Positioned to Advance the Research
Evidence relevant to the second Dhanasar prong may include:
- medical or scientific education;
- specialized training;
- research experience;
- peer-reviewed publications;
- citations;
- clinical research experience;
- patents;
- research grants;
- peer review;
- clinical or scientific collaborations;
- prior successful research projects; and
- institutional resources supporting future work.
Publications
NIW does not require a fixed number of medical publications.
Publications may nevertheless establish expertise, research productivity and prior success relevant to the proposed endeavor.
Citations
There is no fixed NIW citation requirement.
Citations can help demonstrate that independent researchers have used, discussed or relied on the applicant’s medical research.

Clinical Guidelines and Medical Practice
Evidence that research has influenced clinical guidelines, treatment protocols or medical decision-making can provide strong objective evidence of professional impact.
The applicant’s personal role in the research should be documented clearly.
Patents and Medical Technology
Medical researchers may develop drugs, diagnostic platforms, devices, assays or other technologies.
Patent evidence can be useful, particularly when accompanied by licensing, implementation, clinical use or other evidence showing progress beyond the patent itself.
Research Grants
Competitive grants may help establish the applicant’s ability to conduct significant medical research.
The petition should identify the applicant’s role and explain the significance of the funding.
Government Interest
Evidence of interest or support from a U.S. government agency may be particularly useful when it directly relates to the proposed endeavor.
Examples can include research funding, agency collaboration or other documented government interest.
Recommendation Letters
Independent medical or scientific experts can help explain technical research and its broader implications.
Letters are strongest when they identify specific facts and are supported by publications, citations, clinical adoption, grants or other objective evidence.
Physician-Scientists
An applicant may simultaneously be a licensed physician and researcher.
The NIW petition should make clear whether the proposed endeavor centers on research, clinical practice or both and should apply the appropriate legal framework to the activities relied upon.
NIW Versus EB1A for Medical Researchers
EB1A requires extraordinary ability and sustained national or international acclaim.
NIW uses the EB2 and Dhanasar framework instead and does not require extraordinary ability.
NIW Versus EB1B
EB1B requires a qualifying employer, qualifying permanent research or teaching position, three years of experience and international recognition as outstanding.
NIW permits self-petitioning.
Common Medical Research NIW Problems
- relying only on the importance of health care generally;
- failing to define the specific proposed medical research;
- confusing a research NIW with the separate physician-service NIW;
- assuming an MD or PhD automatically establishes NIW eligibility;
- listing publications without connecting them to the future endeavor;
- using citation totals without explaining research impact;
- failing to identify the applicant’s personal role in collaborative studies; and
- failing to address all three Dhanasar prongs.
