EB1B for Researchers
EB1B outstanding researcher classification is available to qualifying researchers who are internationally recognized as outstanding in a specific academic area and who will work for a qualifying U.S. employer in a qualifying permanent research position.
EB1B is employer sponsored. The researcher cannot self-petition.

Core Requirements
A researcher generally must establish:
- international recognition as outstanding in a specific academic area;
- at least three years of qualifying teaching or research experience;
- a qualifying permanent research position; and
- a qualifying U.S. employer.
International Recognition
A strong EB1B petition should demonstrate professional recognition beyond the applicant’s immediate research group or employer.
The regulations provide six categories of evidence, with at least two generally required:
- major prizes or awards;
- selective memberships based on outstanding achievements;
- published material written by others about the applicant’s work;
- judging the work of others;
- original scientific or scholarly research contributions; and
- authorship of scholarly books or articles.
Publications
Peer-reviewed articles commonly support the scholarly authorship criterion. Publication quantity by itself, however, does not necessarily establish international recognition.
Citations
Citations are not a separate EB1B criterion, but they may provide important evidence concerning research influence.
Useful evidence may include:
- citations to important individual papers;
- field-normalized citation comparisons;
- independent researchers relying upon the work;
- review articles discussing the research; and
- evidence of adoption or implementation.
Original Contributions
The strongest contribution evidence identifies the applicant’s specific work and explains why it mattered to the academic field.
Evidence may include independent adoption, citation impact, patents, licensing, clinical use, commercial implementation or later research built upon the applicant’s work.
Peer Review
Journal peer review, conference review and grant evaluation may support the judging criterion when the researcher actually completed the evaluation.
Published Material About the Research
Professional publications written by others about the researcher’s work can support another EB1B criterion when the material meaningfully discusses the work.
Three Years of Research Experience
The beneficiary must have at least three years of qualifying teaching or research experience in the academic field.

PhD Research
Research performed while pursuing an advanced degree does not automatically count. The degree must have been acquired, and the graduate research must have been recognized within the academic field as outstanding if it is used toward the three-year requirement.
What Is a Permanent Research Position?
A permanent research position generally involves employment of indefinite or unlimited duration with an expectation of continued employment unless there is good cause for termination.
The actual employment terms matter more than the title alone.
University Researchers
A university or institution of higher education may sponsor a researcher for a comparable permanent research position in the relevant academic area.
Private Employers
A qualifying private employer may sponsor a researcher through a department, division or institute that:
- employs at least three persons full time in research activities; and
- has achieved documented accomplishments in an academic field.
Both elements should be documented in the petition.
Is PERM Required?
No. EB1B does not require PERM labor certification.
EB1B Versus EB1A
EB1A permits self-petitioning and does not require a qualifying permanent position. EB1B requires employer sponsorship but has a different evidentiary structure.
EB1B Versus NIW
The EB2 National Interest Waiver permits self-petitioning and focuses on the proposed endeavor rather than international recognition as outstanding.
Common Problems
- relying on publication quantity alone;
- failing to document a permanent research position;
- automatically counting graduate research toward the three years;
- failing to document private-employer research staffing;
- showing the employer’s reputation instead of the researcher’s recognition; and
- treating two regulatory criteria as automatic approval.
