NIW Without a PhD: A Doctorate Is Not the Only Path to Underlying EB2 Eligibility
A PhD is not a universal requirement for a National Interest Waiver. Before USCIS reaches the NIW analysis, however, the applicant must qualify for the underlying EB2 classification. Depending on the record, that may be through an advanced degree or its statutory equivalent, or through exceptional ability in the sciences, arts or business.
Underlying EB2 Paths
Separate EB2 Eligibility From the National Interest Waiver
Bachelor's Plus Progressive Experience
A qualifying bachelor's degree followed by at least five years of progressive post baccalaureate experience in the specialty may serve as the statutory equivalent.
Exceptional Ability
An alternative EB2 basis requiring evidence of expertise significantly above that ordinarily encountered.
NIW Analysis
Underlying EB2 eligibility does not itself establish the three NIW prongs.
